The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of school records and gives parents (or students over the age of 18) certain rights regarding their child’s records. Parents are allowed to review their child’s school records and request that schools amend any inaccurate or misleading records. They also have the right to request a formal hearing if the school refuses to change these records. Schools have to receive written consent from parents before disclosing information from a student’s record, aside from directory information such as the student's name, address, phone number, and birthdate. There are some other exceptions to this, as schools can disclose information without getting consent to the following parties:
-
Authorized school officials;
-
The school a student is transferring to;
-
Officials conducting audits or evaluations;
-
Financial aid organizations;
-
Institutions conducting studies for the school;
-
Accrediting organizations;
-
Individuals issuing judicial orders or subpoenas;
-
Emergency health and safety officials; and
-
Authorities within the juvenile justice system under certain laws.
