If an LEA is unaware that a child has a disability before implementing disciplinary actions, the child may face the same disciplinary measures as their peers without disabilities for similar behaviors. However, if a parent or the LEA requests an evaluation for the child during this disciplinary period, the evaluation must be conducted promptly. Until the evaluation is complete, the child may remain in the educational placement decided by school authorities, which may include suspension or expulsion without educational services. If the child is found to be eligible under IDEA, the agency must provide special education and related services in line with IDEA requirements.
