If parents decline or retract consent for an initial evaluation, the school district has the option to proceed through due process or mediation to pursue the evaluation. If the hearing officer supports the school district's decision, they may proceed with evaluating the child. However, if the parent does not respond to a request to consent to the initial provision of special education services, the school district cannot use due process or mediation.
Parents have the right to request an independent educational evaluation (IEE) at the school district's cost if they disagree with an evaluation conducted by the district. In such cases, the district may either file a due process complaint to seek a hearing demonstrating the appropriateness of its evaluation or ensure that an IEE is provided at no cost to the parents, unless the agency can prove in a hearing that the parent's evaluation did not meet its criteria.
