Discovery is the disclosure of relevant documents requested by parties in litigation. The purpose of discovery is to gather as much information from the other side so that your case may be adequately litigated. Imagine if you commenced a suit because you slipped, fell on ice at a skating rink and broke an arm. It would be important to your case to have a copy of any surveillance videos that the skating rink may have. Furthermore, we would want and need all discovery prior to trial to avoid any surprises. It would be prejudicial to one side if the opponent presented at trial with a multitude of documents never exchanged.
