What is DACA? 

Deferred Action for Childhood Arrivals Program.  Those with NO lawful immigration status may seek initial or rewened DACA.  No lawful immigration status means none, nada, walked across border, uninspected or paroled by Customs and Border Patrol.  

Deferred Action:
  • it is discretionary
  • given by DHS
  • granted to undocumented immigrants
  • eligible to apply for work permit
DACA guidelines:
  
  • entered the U.S. without inspection (walked across the border)
  • or fell out of lawful visa status before June 15, 2012; 
  • were physically present in the United States on June 15, 2012, 
  • are currently in school, have graduated from high school, 
  • have obtained a GED, or 
  • have been honorably discharged from the Coast Guard or armed forces; 
  • have not been convicted of a felony offense, a significant misdemeanor, or more than 3 misdemeanors of any kind; 
  • and do not pose a threat to national security or public safety.
  • Application fee:

    • $495 (DACA, EAD and biometrics)
    • no fee waiver
    • very few fee exemptions (foster care, disabled, medical reasons, or below poverty guidelines)

    Expanded DACA:

    • USCIS has suspended the application process for the expanded DACA program.

    Apply for DACA?

    DACA &Social Security number:

    • Once your work permit arrives in the mail, apply for a Social Security number at the Social Security Administration (SSA) local office in your area.
