What is Unilateral Placement?
Unilateral placement refers to the process of moving a student to a private school that offers better special education opportunities. Under the IDEA, a school district is not obligated to cover the cost of education, including special education and related services, for a student with a disability at a private school or facility if the school district has already provided a Free Appropriate Public Education (FAPE). If a parent moves forward with enrolling their child in private school without it being approved or referred by the school district, a hearing may take place to determine reimbursement. If it is found that the school district did not provide the child with a FAPE in a reasonable time before private school enrollment, and that the private school program meets the educational needs of the child, the school district may be required to reimburse the child’s parents for the costs of enrollment.
