In personal injury cases, there are two types of damages: special damages and general damages.

Special damages are losses and expenses that are quantifiable, or can easily be assigned a monetary value. Special damages include damage or loss of property, medical bills, and loss of wages.

General damages, on the other hand, can be more difficult to put a price tag on, since they refer to damages like emotion or mental trauma, physical disfigurement, and loss of quality of life. General damages are commonly referred to as pain and suffering.

Time is of the essence in personal injury cases. There is a a finite window of time to file a personal injury case in a court of law. This is called the statute of limitations, or prescription in Louisiana. The time limit is usually one year from the date the injury occurred.
