Under Florida law, there are 3 different types of divorces. Each type of divorce has differences and similarities to the others, and it’s important to thoroughly evaluate each one to determine which one is right for your unique situation. Here’s what you need to know about each type of divorce.
Contested Divorces
A contested divorce occurs when one party disputes the divorce itself or disputes an aspect within the divorce, such as child custody arrangements. Contested divorces tend to cost more money and take more time than uncontested and collaborative divorces. It also can be much more stressful. In a contested divorce, it is absolutely critical to work with a divorce lawyer in order to ensure that your rights and interests are protected throughout the process.
Uncontested Divorces
In an uncontested divorce, both parties agree on every aspect of the divorce, including property division, child custody, child support, and alimony. If at any time one party disagrees on any aspect of the divorce, it becomes a contested divorce. The most common types of uncontested divorces occur when there’s a solid prenuptial agreement, or when children are not involved.
Collaborative Divorces
A collaborative divorce is a divorce where both parties are actively working together to reach a mutual agreement on each aspect of the divorce. They each have their own attorneys, but the parties use a team-based approach where they work together to achieve goals they have set together. A couple may hire additional professionals like a counselor or a financial adviser to help them reach those goals without having to go through litigation. A collaborative divorce can be lengthy and costly, but it is generally less stressful for everyone involved when the divorcing spouses are working together toward a mutually beneficial agreement.
