When Do School Districts Have to Obtain Written Consent?

A school district is required to obtain written consent in the following situations:

Before a child is evaluated to determine special education eligibility for the first time;

Before a child is initially placed into special education;

Before a child is reevaluated for special education eligibility (if a school has made a good effort to get consent for reevaluation but has not received a response, the district can move forward with the reevaluation without getting written consent first).
Note: written consent for an initial evaluation for special education eligibility does not cover consent for special education placement. A school district must obtain a separate written consent before placing a child into special education and related services.
