Mark is a native North Carolinian. He moved to Louisville after law school and began his practice of law with one of the largest, most well respected firms in the Commonwealth--Wyatt, Tarrant & Combs. Mark stayed with the Wyatt firm for 17 years, 10 as partner.
While at Wyatt, Mark trained under and worked with some of the most accomplished attorneys in this area, concentrating his practice in commercial litigation with a particular emphasis on debtor/creditor law, both in bankruptcy and state court. During that time, Mark worked closely with his then partners, David T. Stosberg and Joan Lloyd, both of whom went on to take positions as United State Bankruptcy Court judges in the Western District of Kentucky.
Mark subsequently was encouraged to apply and was a finalist for a position on that same Court, having a final interview before the Sixth Circuit Court of Appeals. He also has received an AV rating under the Martindale-Hubbell peer review rating system, the highest rating accorded by that system.
Over the years, Mark's primary clients have been banks and other financial institutions that have needed to collect large, secured business loans. Enforcement of those clients' rights has included judicial foreclosures with respect to commercial properties, including shopping centers, apartment complexes and office buildings. Receiverships are often involved and Mark has represented receivers in foreclosures in addition to representing mortgage holders.
Landlord/tenant matters have also constituted a significant part of Mark's practice and he has litigated evictions and lease disputes, representing both landlords and tenants.
In the bankruptcy arena, Mark has extensive experience in all facets of those proceedings, including filing proofs of claim, litigating objections to claims, stay relief, cash collateral disputes, 363 sales, Chapter 11 disclosure statement, plan and confirmation issues, nondischargeability claims, motions to dismiss Chapter 13 cases for bad faith filings, defense and prosecution of preference actions, and representation of creditors committees.
During the course of his career, Mark has obtained significant trial experience in both State and Federal Courts, in bench and jury trials.
Over the years, he has also given presentations at numerous seminars concerning bankruptcy, foreclosure, repossession and landlord/tenant law.
Mark takes pride in being responsive and cost effective. While not afraid to litigate if necessary, Mark always strives to obtain a quick, inexpensive, consensual resolution to conflicts wherever possible. When that option is not viable, however, Mark is no stranger to the litigation process or the courtroom and will thoroughly conduct discovery, prepare and file dispositive motions and try a case if necessary.
