Discipline Date: 01/30/1980 Discipline Activity: Disbarment Discipline Detail: BY ORDER OF THE ARIZONA SUPREME COURT DATED JANUARY 30, 1980 MR. VALENTINE WAS DISBARRED EFFECTIVE THAT DATE. THE DISCIPLINARY BOARD CONCURRED WITH THE LOCAL ADMINISTRATIVECOMMITTEE'S FINDINS OF FACT IN THREE COMPLAINTS.IN THE FIRST MATTER, MR. VALENTINE RECEIVED FUNDS FROM HIS CLIENT TO BE TRANSMITTED TO ANOTHER PARTY AND DEPOSITED THEM IN HIS TRUST ACCOUNT. MR. VALENTINE THEN ISSUED A TRUST ACCOUNT CHECK TO THE THIRD PARTY, WHICH WAS RETURNED TWICE FOR INSUFFICIENT FUNDS. ULTIMATELY, THE MONEY WAS PAID BYCASHIER'S CHECK. THE COMMITTEE FOUND THAT THE RESPONDENT DIVERTED TRUST FUNDS TO A USE FOR WHICH THEY WERE NOT INTENDED AND CONVERTED THEM TO HIS OWN USE. IN THE SECOND MATTER, MR. VALENTINE REPRESENTED THE PERSONAL REPRESENTATIVE OF AN ESTATE IN AN INFORMAL PROBATE. THE COMMITTEE FOUND MR. VALENTINE FAILED TO FILE APPROPRIATE PLEADINGS EVEN AFTER BEING ORDERED BY THE COURT TO DO SO, RESULTING IN REMOVAL OF HIS CLIENT AS THE PERSONAL REPRESENTATIVE AND CAUSING UNDUE DELAY IN CLOSING THE ESTATEIN THE THIRD CASE, RESPONDENT ACCEPTED FUNDS FROM A CLIENT TO BE HELD IN TRUST PENDING SETTLEMENT OF A DISPUTE BETWEEN HIS CLIENT AND ANOTHER PARTY. UPON RESOLUTION OF THE DISPUTE, MR. VALENTINE ISSUED A CHECK FROM HIS GENERAL ACCOUNT TO THE OTHER PARTY AND ANOTHER CHECK, FROM THE SAME ACCOUNT, TO HIS CLIENT, REPRESENTING THE REMAINING BALANCE. BOTH CHECKS WERE RETURNED FOR INSUFFICIENT FUNDS AND AT THE TIME OF THE HEARING, NEITHER PARTY HAD RECEIVED THEIR MONIESTHE COMMITTEE FOUND THAT THE RESPONDENT HAD COMMINGLEDCLIENT'S FUNDS WITH HIS OWN AND CONVERTED THEM TO HIS OWN USE.THE DISCIPLINARY BOARD CONCURRED WITH THE COMMITTEE'SRECOMMENDATION THAT MR.
