CLARK(Bar no. 002881)File no: 01-2449 By Supreme Court judgment and order dated January 13, 2004, Robert G. Clark, 1161 N. El Dorado, Suite 345, Tucson, Arizona 85715, was censured by consent. Mr. Clark was placed on six months of probation, which will include random review of his trust account procedures as well as the creation and maintenance of trust account records. Mr. Clark must pay the State Bar¡¯s costs and expenses of Professional Liability Insurance: Yes Section Membership: Family Law More About: Mr. Robert G Clark , Educated at U of Richmond, admitted to practice in 1968, admitted to the State Bar of Arizona September 25, 1971. Year Admitted To Practice In: 1968,020.96, together with interest at the legal rate.Mr. Clark failed to adequately supervise his non-lawyer assistant, who had complete control of his lawyer trust account and embezzled funds from the account. A review by the State Bar¡¯s staff examiner showed that Mr. Clark failed to properly safeguard client funds, failed to keep his funds separate from client funds by depositing earned fees into the client trust account, failed to maintain complete trust account records for five years, failed to exercise due professional care in the maintenance of the trust account, failed to maintain proper internal controls within his office to adequately safeguard funds on deposit in the trust account and failed to conduct a monthly reconciliation of his trust account. No aggravating factors were found. Five mitigating factors were found: absence of prior discipline, absence of dishonest or selfish motive, timely good faith effort to m" restitution or to rectify the consequences of misconduct, full and free disclosure to a disciplinary board or cooperative attitude towards the proceedings, and remorse.
